Oklahoma-NARO
Legislative Position Statement

OK-NARO supports legislation which provides for fair and equitable treatment of royalty owners. Whenever possible, we seek to work with producing companies and associations on issues of mutual interest, but when agreement is not possible then we will state our position firmly and advocate for royalty owners accordingly. We see ourselves as an organization seeking to ensure that royalty owners’ legal rights are respected and honored.

Oklahoma-NARO Resolution

Be it hereby resolved that the membership of Oklahoma-NARO:

  1. Supports transparency in payment of proceeds;
  2. Supports standardization of check stub information;
  3. Supports release to the public of volume, price, value and deduction information reported to the Oklahoma Tax Commission;
  4. Supports incentives to pay oil and gas proceeds timely, and when proceeds are not paid timely, incentives for the prompt payment on interest on the proceeds;
  5. Supports the use of due diligence in the location of mineral owners for leasing of minerals and payment of oil and gas proceeds;
  6. Supports fair pooling laws that provide certainty and limit the rights transferred to those necessary to develop the minerals;
  7. Supports the requirement of good faith negotiations prior to the ability to file a force pooling action;
  8. Supports fair determination of surface damages in the District Courts of Oklahoma, with a right to jury trial if the matter can not be resolved;
  9. Supports the elimination of the escheat of producing minerals resulting from production proceeds being paid into the unclaimed property fund; and
  10. Supports retaining the ability for royalty owners to maintain class actions, where the court determines a class action is appropriate, for the collection of unpaid royalties and damages.
